If you are on H1 and switch to another H1- you do not need to worry about Cap
If you are on H1 and switch to EAD- you have relinquished your H1.Whenever you wish to resume your H1- at that time you will go against the Cap.

What about if one comes back on AP and hence has to use EAD but also has a valid H1 approval ( but no stamping in the passport ) . Can they go back and use that H1 approval for stamping and come back on H1 ? They are still working for the same company which sponsered the H1 and the GC

Noone is asking for exact dates from USCIS. We are all still very much in a limbo and this is just for getting some heads up!!

So you apply about 4 months in advance? Are you then not losing about 3 months of your previous validity due to this practice?

If your new validity date starts before the current one expires then yes you might lose the time depending on how fast your EAD was approved.
In my experience there has been no consistency in the issuance of the validity date in the past. I have received cards where the new validity date has been the day after my current EAD expired thereby me not losing any time and there have been times when I have lost time due to new validity date being prior to my current one expiring.
As per USCIS rules you can apply for renewal 120 days before your current one expires and not before that. Remember you can also apply for renewal a day before or even after expiry, its just that you cannot work as long as you do not have a valid EAD(or other work permit like H1B, L1 etc).
So as long as you are not at the risk of losing your job due to no EAD in hand I guess you can apply anytime once your 120 day window kicks in.
PS:Above is just my understanding of the system and should not be taken as legal advise. For any clarifications please consult your attorney.

A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

Yup - that response looks very similar to the Feinstein response I got. I wrote back to correct her staff on the intent of my original letter, using some of the information and stats from IV.

Your GC is your responsibility. Better to know all AC 21 regulations and act accordingly. Lawyers do goof up. I suggest you take conservative stand unless you are ready to take any risk. Personally I am risk averse as far as GC is concerned. Think whether the extra dough or career change is much needed for you.
The job title Technical Recruiter itself is like painting target on the shirt and going into the field. I think RFE is guaranteed.

Different lawyers have different opinion about it. Some believe you lose the PD once the 140 is revoked but others believe the PD is yours for life even if the underlying 140 is revoked later on.
There are some risks in changing jobs based on 140 and depending on your personal situation, you got to decide whether the risk is worthy or not.
One reason that all lawyers agree on is you can lose your PD if the 140 is revoked for fraud. But then thats a completely different ball game.

There is nothing wrong with anyone getting a green card but the process should be fair. There is nothing fair about getting GC within 6 months while people are waiting in line for 6- 8 years. All those who are getting in 6 months - good for them but the system should address it fairly. Its high time they look into it specially with retrogession coming into the picture.
I agree, It is actually high time that we call our lawmakers and let them know about how broken it is. They have no clue about all of this. So yes, we need to make it fair, we need to be proactive and START CALLING OUR LAWMAKERS.
