Hello,
So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.
Did the IO made a international call (as you said you are out of country) to speak with you? If so how did he get your internation number.

I have applied for Advanced parole at the end of July 2007. My H1B visa is expired, but my H1B petition is still valid. Should I just take the risk of traveling and try to get H1B visa renewed to re-enter ?
OR should I just keep waiting for Advanced Parole to be approved ? I can wait until end of November 2007. But I am not sure whether I should plan to travel in Dec 2007 or not. I dont know how long its going to take to get the approved AP.
Any thoughts ?? Do any of the July filers who have filed for AP know what time frame should we expect for approval of I-131 (AP) ?

You should be very careful of what you plan to do.
Your 797 validity has nothing to do with your ability to enter the US. Its your passport visa stamp that is examined at POE, i am sure you are aware of it. So if you wish to travel on your H1 and enter back then make sure your visa stamp is valid or make plans to get a visa stamp from your home country.
No second guesses on when your approved AP might come, so if you are ok with renewal of visa then go for it. Its your call.

Can IV contact some of our members in and around Dallas area to attend this meeting? IV can help them to prepare the key points regd our retrogression problems/solutions and the urgency to implement this solution. so that, it will be easier for them to present it to the hearing committee.

It is 7 years for sure.
I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.

I have been working for company A for last three years and they filed for H1 extension with Vermont service center under premium processing and today my company fot a fax from USCIS asking some questions regarding my managerial qualifications even though they have filed my application based on senior analyst programmer position. In my department I am the only programmer under my manager. Others are data analyst person and they directly report to my manager. Here are the following questions that has been asked by the USCIS:

How many subordinate supervisors were under the beneficiary's management ?
What were the job titles and job duties of the employees managed ?
What executive / managerial and technical skills were required to perform the overseas duties ?
What defree of discretionary authority in day to day operations did the beneficiary have in the overseas job.
A final decision will not be made for 33 days. During that time you may submit evidence to overcome the reasons for denial.

It's not the "IMHO" or anything... we certainly all are entitled to opinions - "Canon is better than Nikon" "Nikon is better than Canon" "Contax/Carl Zeiss is better than either" "What are you thinking, Minolta has fine glass too" etc. But it is just the "far superior" thing that got me going, because it simply isn't true, while the other statements certainly do have parts of truth to them. I guess some people do treat camera manufactureres with the same kind of "fanboy-ishness" that geeks do to Intel or AMD. ;)

I did not say far superior lenses.
I'm not going to get into some sort of contest and I am not looking for an argument, nor will I return with derogatory retorts.

You cannot apply for EB1-OR on your own. Only EB2-NIW and EB1-EA can be self-sponsored. If your employer applies for EB1-OR then it might be easier than EB2-NIW since you don' have any citations. To find out "NIW in your own field", talk to your adviser ... he might know other students who applied. You lawyer might have handled cases in your field. You are correct but I think I am not sure if one can change employer (H1B Transfer) during that 3 Year extended H1B period after 485 denial.
That seems to make sense, because there is no such a thing like a H1-B transfer as every application is a new one, so you can't really file a new H1-B with no grounds when 485 is denied and you have already used up 6 years. But my friends, but but but, you can always file a Labor with employer B and when its pending more than 1 year, apply for H-1B extension/transfer. Woo hoo...

I have bunch of colleages who have filed 485 two years ago and they are all saying you can take different responsibilities. I thought they would have done better research on this one as they are at that stage. May be they are wrong. I beleive their 485 is status is at "pending approval". Does anyone know what could be the possible final status for 485 during retrogression? This may be the decider for both AC21 and existing employer role change. Can anyone confirm this one?

The reason was that the base labor was already utilized by his employer for another employee and that guy got GC about 2 months before this guy. Incidentally both are friends and worked for the same company. But USCIS was kind enough to allow him to continue provided they file for new labor through Perm and they also got the Old PD. Then they applied in Perm through Sheela Murthy and then got their GC in almost like 45 days. This happenned about 8 months back. PLEASE REMEMBER THIS SITUATION. I am not sure if this is USCIS mistake for approving 140 for 2 people with the same labor. This still haunt's my friend's family as I remeber the day they got the rejection letter.

So a better assumption can be "send photos".

I have been banned too - simply because I raised the cause of international students and IV's duplicity in its stance, and that makes some GC-greedy members paranoid. :D

You have repeatedly used offensive language and several of your posts have been deleted in the past. If you want IV to focus on student's cause, then you will need to work on that effort. IV can offer a platform. You continue to post hateful messages against IV. IV is a platform and if you want to do something get students together on a platform, we will guide you. Just like we are helping people stuck in Perm Audits these days. But it is upto people who are stuck to take up the challenge and not expect someone else to do it for them and they will simply come to the site and pass judgments.

VB was distorted by the fact that LC process was expedited and back-log was cleared recently. Some of those with early PD just got LC approved and able to file last July 2007.
Therefore, getting back to old VB is not expected soon. I predict that it can take a year or so before it gets back to May 2007 VB.

it is a great idea. It takes a lot of work to organize an event like this. We will get a lot of publicity and it will be a good fund raising event as well. Would you be willing to take a lead on organizing an event for us?

Even I got an FP notice 3 weeks after getting the welcome notice. Then they also updated the status to Card Production Ordered and Post Decision Activity. Finally got the card after more than a month. I still have to go for FP later this month. I don't know what the hell is going on but at least I got the card.
I am still waiting for my card, but I received a FP notice yesterday. I think I'll get my card once I am done with my FP.

Its not a legal loophole. Some states just do it that way. Their under pinning argument is that you are on a temporary visa and does not have permanent residency. Also, its not the University that makes up the rules. There is some thing called domicile office in most schools and they determine residency for in state/out of state purposes. The domicile office has specific set of instructions on how they should determine eligibility requirements for in state. For example common wealth of VA has state council for higher education (http://www.schev.edu/Students/VAdomicileguidelines.asp?from=students) that provides these guidelines. Check out what AZ has to say and if they say only permanent residency is a requirement to be eligible for in state, there is nothing much you can do.
Also, its not a federal violation as states decide what they want to do with their university systems. If you want you can write to your state senators and assembly man and see what they have to say. Its very difficult to explain them these nuances when there are a bunch of people crying out loud that many illegals are getting in state rates.
