Are the processing times according to the notice date or the received date ? Mine are 4 months apart.
It is based on Received date but some are saying that CIS is not really following that but in "THEORY", its the RCVD Date.

The main issue is not the expiry date of the DL, the issue is why make us verify all the documents and add the 6 month validity constraint even for "Change of Address" requests, and why give us a completely different Vertical Style DL unlike the standard Horizontal style DL.
Also, I have not reached that stage, but what happens with people with EAD? You have to renew every year and can renew only 120 days before Expiry. The expiry date of DL and expiry date of EAD will keep chasing each other and at some point you will LOCKED OUT of DL because of the 6 months validity constraint...

While we wait for October 1st (assuming visa numbers are over), what can be done in the next 13 days?
I am checking with different attorneys, and might change from my current attorney as he is totally useless. He opened a SR for me, and everytime I call him, he tells me to wait for 30 days.
I have taken Infopass, met the local senator, opened SR and nothing worked. Any ideas on what can be done next?

If one changes from EB3 to EB2, then priority date is lost!

(I am not expert) but I believe , you have to refile (New application) under EB2 catagory and port the EB3 date to EB2.

Mailed is not equal to received or applied for transfer. Until you have proof that USCIS has received your application, dont start at the new employer. Waiting for the receipt # is the safe route down the road even though you have to delay by a week or so.

I agree. Aware members need to inform ignorant members obsessed with notices on other threads and stop those therads NOW. We have tolerated such threads enough. I am not joking, you will see from today new threads of EAD and AP trackers for the next 6 months. So let us all nip this in the bud in the interest of this organization. What do you think?

It's not a tracker and I'm not tracking or looking for my receipt notices to come from USCIS or my checks to be cashed or anything like that.
My notices have already arrived and my lawyer and employer are refusing to give them to me. I have foreign travel planned in October and I might be looking to change employer soon. My question was whether I can invoke AC21 without having the physical receipt notices.
Would be helpful if someone knows for sure.

My understanding is that Sen Maj. Leader and Min leader pick senate
conferees. Similar with house. Democrats support the bill. Most of the
republicans oppose it. House and Senate Bill are different like day and
night. The bill has to pass because.
1. Enforcement and Boarder protection is highly needed and the house
really want it. If they need it they have to make some sacrifice accepting
guest workers program with slight modification etc. Otherway the CIR supporting conferees may not agree and bill dies leaving things same as now
which nobody wants.
2. Election is approaching. Most of the leaders in Rep party openly admitted
that Enforcement only bill will affect them adversly
3. Mr. Persident is a strongly supporting Guest Worker program.
4. If a enforcement only bill is pased thats going to affect the relationship
with Mexico.
I believe the House is against legal immigration too. Otherway some provisions might have survived in the budget bill. My biggest worry is that
if CIR supporters and Opposers (conferees) will be happy to remove legal immigration provisions in the in the reconcilation process and call it deal!

I have changed jobs recently using EAD after over 180 days of filing 485 and 140 approval. Process is pretty simple if you do not wish to notify USCIS like me. Just fill out a I-9 form with EAD details with your new employer and give them a copy of the card (front and back) and with passport copies. Job title and description do not match completely with the LCA. Employer will help with employment verification letter with salary/title/responsibilties if and when a RFE is received.

My personal situation: I was on F1 visa for 6 years before I started LC process with a company for a totally unrelated to my field of studies position (EB3). We had PERM approved and filed I-140, with me still on F1. I-140 was approved and now we are stuck in retrogression. Meanwhile, and after I-140 was approved, I graduated and applied for H1B based on my major. I have disclosed on H1B application that I have I-140 approved from another company and attached a copy. Not a question asked. H1B was approved within 9 days (cap exempt).
And there's more. Because I violated my F1 status years ago by accepting unauthorized employment (tracable through taxes), my lawer told me to leave the country and re-enter, to cut the tail clean and be eligable for adjustment of status when the quotas open up. I went to Canada, and applied for H1B visa stamp, disclosing on the applicqation that I have I-140 approved and have violated my visa terms previously ("yes" to question 38, in "kiss of death" section of the application). Very stressful time that was. But in the end - no problem, got the stamp and was back in two days.
