As per law, one must always carry the original GC with them, like DL. You can see this instruction in 485 approval notice/welcome letter. I am doing it.

AC21 cannot be used before 180 days. Also the employer may be upset if you take a vacation and do not return. Why not give two-week notice and quit normally? Plus, the new job is contract to hire. To use AC21, the new employment offer has to be permanent, IMHO. Programmer analyst to DBA may not be a big issue. You have to try to make sure your previous employer will not withdraw I-140.

Applying for and obtaining approval of EAD or Advance Parole does not affect the 485 applicant's "nonimmigrant status" including H and L. However, once the alien starts work using an EAD or travels on Advance Parole, the alien is considered no longer in a nonimmigrant status including H and L.
I didn't know if we use AP we loose H1, any comments Seniors?

Winner, Could you or somebody please inform the blog owner of the issue (I am not visting that site again :eek: :mad:). I lost a day due to the virus, don't want anyone else to experience that... this was a pretty nasty virus. Be warned & very careful out there guys!!

This year i believe it is not based on SSN, is it not whether you are filing jointly or single ?

Please don't mistake BerkeleyBee's post. From the point of view of the core team, many posters have ideas that seem correct to them and they post 'This is my idea, why can't we do this?'. In plain language, that translates to 'Why can't the core team do this?'.
So from my point of view - simply as someone who has been posting for a long time in Usenet, newsgroups etc - if you have a good idea, implement it yourself. E.g., if you want a webfax that thanks Senators, write the webfax and post it. Sample webfaxes are available on the website, customize it and post it. The "core team" is human. We are balancing full time jobs with the web site and it would help if people making suggestions also implemented it.
In this idea that has been posted re: educating people in other countries, that is NOT part of IV's mission. IV's mission is clear: it is social service to people that want to get a green card. It is also social service to educate prospective immigrants about the delays in the GC process. However, that is not part of IV's mission. It can be part of Bkam's and Learning01's personal missions, however.
I think the one additional thing is also that we need to using harsh terms to blame the U.S. system or Congress for our problems. Lots of people have problems, Congress has limited time to tackle everyone's problems. As someone prominent that we met said 'War on terror, injustice to immigrants.. You know what is going to win every time'. So let us keep perspective and soldier on, remember we are also getting prominent, so now is the time to present ourselves and the forum in the best light possible.

I have used it. I-140 approved. Currently working on EAD. Got the letter from new employer mentioning title similar to both of my GC labor bassed application example: title: Title1(EB3 based - old app/Title2(EB2 based - New app). I will be using that letter to inform USCIS for my AC 21 usage. I am waiting for my lawyer to take that task into his hand.My both GC is based on different but close labor codes. Currently I have not decided to port PD to new file but once I decide the same letter will work for that as well. My letter just mentions title and salary and which department I am working and to whom I am reporting. According to lawyer there is no need to put "Job Description" at all in that letter. I originally got the letter with job description (matching both codes) but my lawyer advised me to remove "job description" and thus I had to take another letter.

I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?

I'm sure you can give these guy's a run for their money. One thing - if you pursue it long and hard enough I think there is a chance that you can get instate tuition. The only area I was concerned about was the domicile part but if L1's can prove domicile so can H1-B's.
My son was able to get in-state tuition at Arizona State University after we filed an appeal. The new rule allows those who have filed I-485 to get in-state tuition.

I see an update on jan 24 on this bill to grant 55000 visas for advance degree holders from DV lottery. Does this mean progress? Rest of the immigration bills never make it to the sub committee.

That would be the way to go. I assume you will probably look at a career change or change the job responsibilities in the same field, which may be a factor for the prior GC going to the boondocks. If on the other hand, you intend to stay in the same field and similar job profile, then striking a deal with your employer (that you would come and join them after your MBA) would be a way to keep your current GC process going. A leave of absence in that case would be the way to go.
You will get jobs easily in Europe after an INSEAD MBA. Why bother about coming back to US, and getting in the GC queue again?
