    If you are on EAD before leaving US, you better to continue the same status. Their might be a situation for USCIS considering giving up your AOS, if you enter US on H1b while you were on EAD before leaving US.

    Yes you can claim them as dependants. I have done this in the past. All you have to do is file the ITIN application with your Federal Tax Return.

    EAD and AP is good, but we need to see FP notice which shows 485 has started processing.
    We really cannot use EAD for 6 months to change job, so there was no hurry to mail EAD/AP.
    Anyone got FP notice ? Will it come from NSC or CSC.
    Most likely NSC as FP starts when processing starts.
    EAD/AP are seperate from 485 process as per the operating procedure.

    What if you have to leave the job before 180 days, about after 150 days? When I say you have to that means there is no alternative. Employer-Employee issues. Quite a few folks here might be aware of it. But anyway, I read that USCIS will consider 180 days based on the I-485 'Received Date' and I-140 'Revoked date' will be the date USCIS act on the letter they receive from Employer requesting to revoke I-140 not the date employer will send letter to USCIS. I'm aware that there is no specific guidelines of which date USCIS will consider as 'Revoked date', but I heard USCIS mentioned verbally in many conference that they consider I-140 'Revoked date' as when USCIS act on the letter they receive from employer. Any thoughts?

    My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know

    1. How many days is required to get a H1b transfer receipt.

    2. What happens if my H1B expires before i get a receipt.

    3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.

    We all know why! America decided it's smarter than anybody else: "Hey, let's let new people into the country and then exploit them for as long as possible! There are so many ways not to: overcomplicated "process", quotas on Green Cards, processing delays, no fixed, mandatory processing times, etc." Once you realize the main goal of the immigration policy - to create permanent underclasses whom America can discriminate and exploit, everything that happened in the immigration history of USA, especially recently, becomes very logical. Unfortunately, it's a long time tradition in US to exploit and discriminate "recent" immigrants. Remember "No Irish need to apply"? How about the Chinese workers who built the transcontinental railroad and then were lynched and Chinese were effectively banned from immigrating to US for the next 70 years (see shusterman.com for more historic examples).

    I'm providing updates here just for future reference for others -

    I called the local airport CBP office (even though my last port-of-entry was different), and talked to an officer there. They said that they will handle this issue as long as I can show my passport and visa information.

    Phew, that is a relief.

    Oh, btw it turns out that the one officer responsible for handling this is on vacation, so I have call again after 2 weeks to schedule an appointment.

    Dude, You can use I-94 card as a toilet paper when you take the very first exit in Canada. You are leaving for good! Do not worry about it. Meanwhile, congratulations for taking this bold step and moving to Canada after 6 years of H1-B. I wish you well.

    It's ridiculous how people start to bad mouth everything related to US once they get a PR from another country, especially Canada. It�s like kicking off the same ladder that you used for climbing.

    1. You gained entry into US with the �toilet paper�.

    2. The �toilet paper� allowed you stay legally in this country.

    3. The legal stay enabled you to apply for Canadian PR from Canadian Consulate General in Buffalo where the processing time is less than 2 years.

    4. The legal stay enabled you to earn sufficient funds which you showed as proof of funds in your application papers.

    5. The legal stay enabled you to get police clearance certificates from FBI and also from your country�s consulate in US.

    Now let�s say you didn�t have this �toilet paper� and applied for Canadian PR for India.

    1) You would only be eligible to apply from Canadian Consulate General in NewDelhi where the processing time is more than 5 years.

    2) If you are from a middle class background, then you would have a hard time in providing the proof of funds for a family of 4, with your earnings from India.

    3) You would have to grease the palms of police to get police clearance certificates and they are gonna take their own sweet time to provide you these documents.

    Now be thankful that you got away from all these with the �toilet paper�. And remember that you are leaving to Canada not because of your love for the country, but because you didn�t get your US GC on time. Sour grapes, huh?

    I know that i will be getting red dots for this post from hypocrites and I don't give a damn about it. All I can say to them is "Instead of pressing your finger against the mouse, press it against your forehead and think about the benifits that you milked from this country".

    Zcool,
    I applied for my H-1B extension and got an RFE asking for contracts and client letters for the requested period i.e., for the next 3 years.
    I see that they asked for client letters from you ... but did they ask for the next 3 years? and if so, did you guys reply the RFE with a client for 3 years?

    I have been working at the same client for the last 3 years, through a vendor. Mine is a small consulting company. The client has been extending the contract in 6 month increments and I could get a client letter for the next 6 months only.
    Same is the case with the contract.

    I could not file for 140/485 in july, 07.. so do not have the EAD safety net.
    Please advise.

    You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

    I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!

    C'mon...Guys, come to Ohio..you will get DL for 4 years..

    My Ohio license will expire soon along with H1B. As far as my attorney says, when the original H1B application receipt presented, BMV issues one-year renewal. With the H1B approval, they renew the license for three years.

    is that this bill will easily pass also the House. The problem is that the Speaker and the house leader has some agreement that the only bill that goes to the floor must have the majority of the republicans votes. That is the reality. I am positive that if nothing happen this year, it will happen next year if the house will go under the Dems.
    The reality is that a little group of republicans (not even conservator, Mc Cain and Flakle are conservator and you see their opinion) are agianst any type of immigration.

    Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.

    As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

    Guys, I wanted to circle back and update you on the results. My I140 was approved today and this is what i had submitted as alternate evidence. Hope someone else will benefit from the details I am putting here.
    Thanks to you all who took time to reply and assist me on this issue.

    Documents submitted:
    > Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
    > Email trail of communication with ex-employer detailing communication asking for exp. letter.
    > 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
    > For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).

    RFE was :
    Asked for evidence to prove 60 months of experience as listed in PERM.
